What This Covers

A Vettify family law opinion covers marriage, divorce, dower (mahr/mohorana), maintenance (nafaqah), custody (hidana), guardianship, inheritance distribution, and related family disputes. We review your documents — nikahnama, talaqnama, court orders, mediation agreements — and provide a written legal assessment of your rights and obligations under Bangladesh law.

Common Scenarios

Your husband asks you to sign a talaqnama that includes a waiver of your dower or maintenance rights. You want to understand your inheritance share before agreeing to a family settlement. You are separating and need clarity on child custody arrangements. A family member is withholding your share of inherited property. You received a talaq notice and want to know your rights regarding the iddat period and post-divorce maintenance.

What the Opinion Includes

Your sealed PDF opinion will include: a summary of your legal position under the applicable family law framework, identification of your rights (dower, maintenance, custody, inheritance), a review of the documents you submitted, and a clear recommendation. All references are cited and the opinion is signed by the reviewing advocate.

Frequently Asked Questions

What is dower (mahr) and can it be waived?
Dower (mahr or mohorana) is a mandatory payment from the husband to the wife at the time of marriage under Muslim law. It has two components: prompt (mu'ajjal) dower, payable on demand, and deferred (mu'wajjal) dower, payable on dissolution of marriage or death. A wife can voluntarily release her dower, but a waiver signed under duress or without understanding may not be valid. A Vettify opinion can review your nikahnama and advise on your dower rights.
What happens after a talaq notice is served?
After talaq (divorce) is pronounced, there is an iddat period (approximately 3 months for a menstruating woman) during which the wife cannot remarry. The husband remains obligated to provide maintenance during iddat and to pay any outstanding deferred dower. A Vettify opinion can clarify your specific rights and the timeline for any required registrations or court filings.
How is child custody decided in Bangladesh?
Custody (hidana) follows personal law principles. Under Muslim law, the mother generally has the right to custody of young children (sons up to about 7, daughters until puberty), while the father is the natural guardian. These are general guidelines — courts consider the best interests of the child. A Vettify opinion can assess your specific custody situation.
